Rubbish Removal Brixton Terms and Conditions of Service
These Terms and Conditions set out the basis on which Rubbish Removal Brixton provides waste collection and rubbish removal services to domestic and commercial customers. By placing a booking or allowing our team to commence work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings given below:
1.1 We, us, our refers to Rubbish Removal Brixton, the provider of rubbish removal and waste collection services.
1.2 You, your refers to the customer, being the individual, business or organisation requesting our services.
1.3 Services means any rubbish removal, waste collection, clearance, loading, transportation, disposal, recycling, or related service that we provide.
1.4 Premises means the property or location where the Services are to be carried out.
1.5 Waste means any rubbish, refuse, junk, debris, furniture, appliances, garden waste, construction waste, or other materials you ask us to remove, excluding Prohibited Waste as defined in these Terms and Conditions.
1.6 Prohibited Waste means any hazardous or restricted materials including, but not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, petrol, diesel, gas bottles, paint, batteries, tyres, explosives, or any materials classified as hazardous under applicable law.
2. Scope of Services
2.1 We provide rubbish removal and waste collection services, mainly in and around Brixton and the wider London area, subject to availability and operational capacity.
2.2 Our Services typically include the loading of Waste from your Premises, transportation, and delivery of such Waste to a licensed disposal, recycling, or treatment facility.
2.3 We reserve the right to refuse to remove any items that we reasonably believe to be unsafe, unlawful, excessively heavy, difficult to access, or falling within Prohibited Waste.
2.4 Any times or dates for attendance at your Premises are estimates only and subject to traffic, operational demands, and unforeseen circumstances. We will use reasonable efforts to meet agreed times but do not guarantee exact arrival times.
3. Booking Process
3.1 You may request a booking by telephone, email, or online contact form. A booking is only confirmed when we have provided you with a confirmation by verbal agreement or written correspondence.
3.2 When making a booking, you must provide accurate information about the type, volume, and approximate weight of Waste, as well as access conditions at the Premises, such as stairs, parking restrictions, or limited access points.
3.3 Any quote given before attending your Premises is based on the information you provide and is an estimate only. We reserve the right to revise the price once we have inspected the Waste and assessed the work required.
3.4 You must ensure that you or an authorised representative is present at the Premises at the agreed time to grant access and confirm the items to be removed. If no one is present, we may cancel the booking or charge a reasonable waiting or call-out fee.
4. Quotations and Pricing
4.1 Our charges are generally based on some or all of the following factors: volume of Waste, weight, type of materials, labour required, access conditions, parking costs, and distance travelled.
4.2 We will explain how our pricing works at the time of booking or upon arrival. Any initial quotation is subject to confirming the quantity and nature of the Waste at the Premises.
4.3 If, upon arrival, the actual quantity or nature of the Waste significantly differs from what was described at the time of booking, we may adjust the price accordingly. You will have the option to accept the revised price or decline the Service. If you decline, we reserve the right to charge a call-out fee to cover our costs.
4.4 Unless otherwise stated, our prices include reasonable labour for loading your Waste. Additional charges may apply where loading is particularly time-consuming, involves difficult access, or requires dismantling or special handling.
5. Payments
5.1 Payment is due in full on completion of the Service, unless otherwise agreed in writing in advance.
5.2 We accept payment by cash, bank transfer, or card payment methods that we choose to make available. We do not accept cheques unless expressly agreed.
5.3 Where we have agreed credit terms with a business customer, payment must be made within the period specified on the invoice. If no period is stated, payment is due within 14 days of the invoice date.
5.4 If you fail to make payment when due, we may charge interest on the overdue amount at the statutory rate permitted by applicable UK law, accruing daily until payment is received in full, as well as any reasonable costs of recovery.
5.5 Ownership of any materials or items we agree to purchase or salvage from you transfers to us only when we have received full payment of any sums due to us for the Service.
6. Cancellations and Amendments
6.1 You may cancel or amend your booking by giving us at least 24 hours notice before the agreed arrival time. Cancellations made with sufficient notice will not usually incur a charge.
6.2 If you cancel less than 24 hours before the agreed arrival time, or if we are unable to carry out the Service due to your failure to provide access or accurate information, we reserve the right to charge a cancellation or call-out fee to cover our costs.
6.3 We may cancel or reschedule a booking where we are unable to carry out the Service due to circumstances beyond our reasonable control, including extreme weather, traffic incidents, staff illness, equipment failure, or regulatory restrictions. In such cases, we will contact you as soon as reasonably practicable to agree an alternative time.
6.4 We reserve the right to refuse or cancel a booking where we believe the Service requested is unsafe, unlawful, or not commercially viable. Any payments made in advance for such cancelled bookings will be refunded, except where cancellation is due to your breach of these Terms and Conditions.
7. Access, Parking and Your Responsibilities
7.1 You are responsible for providing safe and reasonable access to the Premises and to the Waste to be collected. This includes ensuring that walkways and areas are clear and that there are no health and safety hazards.
7.2 You must secure any necessary permissions for us to park or load near the Premises, including arranging visitor permits, pay and display tickets, or loading bay access where required. Any parking charges, fines, or penalties incurred as a direct result of your failure to provide suitable parking arrangements may be charged to you.
7.3 You must clearly identify all items that are to be removed and ensure that no items intended to be retained are included among the Waste. We are not responsible for items that are taken away in error where those items were not reasonably distinguishable from the Waste.
7.4 You must not request us to remove Prohibited Waste and must inform us immediately if you become aware that any Waste includes hazardous materials. We may refuse to handle such items or may arrange specialist removal at additional cost.
8. Waste Handling and Regulations
8.1 We operate in accordance with relevant UK waste management legislation and regulations. We will only transport and dispose of Waste at authorised facilities and in compliance with applicable environmental laws.
8.2 Where required by law, we will carry appropriate waste carrier registration. You acknowledge that we may keep records, including transfer notes, in connection with the collection and disposal of your Waste.
8.3 We will use reasonable efforts to maximise recycling and recovery of materials, but we do not guarantee that any particular proportion of Waste will be recycled.
8.4 You confirm that you have the authority to allow us to remove the Waste and that the Waste is your property or that you have obtained all necessary consents from the owner or relevant third parties.
8.5 If we suspect that any Waste is not lawfully in your possession or that its removal would be unlawful, we may refuse to carry out the Service and may notify the relevant authorities if appropriate.
9. Liability and Limitations
9.1 We will carry out the Services with reasonable care and skill. If we fail to do so, you may be entitled to a remedy such as a repeat performance or a price reduction, in accordance with your statutory rights.
9.2 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.
9.3 Subject to paragraph 9.2, we will not be liable for any indirect, consequential, or special loss or damage, including loss of profits, loss of business, or loss of opportunity, arising from or in connection with the Services.
9.4 Our total liability to you for any loss or damage arising out of or in connection with the provision of the Services, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable by you for the specific Service giving rise to the claim.
9.5 You are responsible for securing or removing any fragile or valuable items that could be affected during the removal process. We are not liable for pre-existing damage to property, wear and tear, or defects in structures, fixtures, or belongings.
9.6 While we take reasonable care to avoid damage to property during the loading and removal of Waste, you accept that minor scuffs, marks, or disturbances may occur, especially in tight or difficult access areas. You should notify us immediately of any alleged damage before our team leaves the Premises.
10. Customer Conduct and Misuse
10.1 You must not misuse our Services or request any action that contravenes applicable law or regulations.
10.2 We reserve the right to withdraw our team and terminate the Service immediately if they are subjected to abusive, threatening, or unsafe behaviour. In such cases, you may remain liable for all or part of the agreed charges.
11. Complaints and Disputes
11.1 If you are dissatisfied with any aspect of the Service, you should notify us promptly, ideally within 48 hours of completion, providing full details and any supporting evidence.
11.2 We will investigate complaints in good faith and seek to resolve them fairly, which may include offering to rectify any issue, providing a partial refund, or other reasonable remedy where appropriate.
11.3 If a dispute cannot be resolved between us through our internal process, either party may pursue their rights through the courts or any other dispute resolution method available under UK law.
12. Data Protection and Privacy
12.1 We may collect and process personal information such as your name, contact details, and address for the purpose of handling bookings, delivering the Services, issuing invoices, and maintaining records.
12.2 We will handle personal data in accordance with applicable data protection legislation in the UK. Your information will not be sold to third parties and will only be shared where necessary to provide the Service or to comply with legal obligations.
13. Changes to These Terms
13.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, or our business practices.
13.2 The version of the Terms and Conditions that applies to your booking is the version in force at the time your booking is confirmed. We recommend that you review these Terms and Conditions regularly.
14. Governing Law and Jurisdiction
14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
15. General Provisions
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
15.2 No waiver by us of any breach of these Terms and Conditions shall be considered a waiver of any subsequent breach of the same or any other provision.
15.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to deliver the Services.
15.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the Services and supersede any prior discussions, correspondence, or understandings between us.
